Guidance for the people who hold the deadline

Agencies miss responsive records because nobody searched where the record was. A document sits in a departmental folder outside the systems anyone thought to check, and it surfaces later by another route. This is the failure that turns an administrative process into litigation, and it is a coverage problem rather than a diligence one.

An agency can withhold only what a specific exemption covers, has to release the rest of the document, and needs to be able to show its reasoning afterward. Most disputes turn on that third part. The exemption was arguable, but nobody recorded why it was applied, so it cannot be defended.

Video redaction means tracking and obscuring faces, screens, documents, and identifying audio across every frame in which they appear. An hour of footage can take many hours to review, which is why video requests dominate the backlog in agencies that receive them.

Information escapes a redacted file in four main ways: a black box drawn over text that was never flattened, metadata and document properties, tracked changes and comments left in the file, and hidden rows, columns, or slides. In every one of those cases the document looks correct when you open it.

Because the reasoning is rarely written down. Two people reading the same exemption reach different conclusions, and the same person can decide differently six months apart, because nothing carries the earlier judgment forward. Inconsistency is a record-keeping failure before it is a judgment failure.

Every document considered, where it came from, whether it was released, redacted, withheld, or excluded, the exemption cited, who approved it, and when. The test is whether someone who was not involved could reconstruct the decision from the record alone, a year after the file closed.

Identify the custodians likely to hold material, then search each system they use: mail, document libraries, collaboration tools, case systems, and older storage. Scanned material needs optical character recognition to be searchable at all, and email threads are best handled as single documents rather than dozens.

Score it on intake for subject, likely custodians, and volume, then send it to a named owner rather than a shared mailbox. Requests touching several departments need one accountable owner and separate tasks, or every department assumes another one is handling it.

Escalate on a schedule rather than on frustration, and document every attempt. The statutory clock runs against the agency as a whole, not the department sitting on the material, so the records officer carries a deadline for work they cannot compel. A written escalation trail is the only real protection.
